Rules and Regulations for Renting a Vehicle at Iron Skull Motorcycle

1. Valid Driving License
IS MY DRIVING LICENSE VALID IN SPAIN?

To rent a scooter 125cc:
- You need a valid EU or International driver’s license A1, A or B (held for at least 3 years).

To rent a Harley-Davidson:
- Minimum age: 28 years.
- A valid EU or International motorcycle license (Class A) held for at least 3 years.

2. Compensation and Accidents
- If the renter/driver is at fault in an accident, they have no right to claim another vehicle.
- The renter/driver has no right to claim compensation from the hirer.
- If the renter/driver is not at fault, they may claim a replacement vehicle for the remaining rental period only if a similar vehicle is available. No other compensation will be considered.
- In case of traffic accident, theft or vandalism, the police must be notified immediately.
- In case of an accident, the renter must fill out the included insurance claim form at the scene.
- If the renter does not fill out the form or does not fill it out properly, Iron Skull Motorcycle is entitled to withhold the deposit until all insurance claims are clarified.

3. Cost of Cancellation
- When booking online, a deposit of 50% of the total rental amount must be paid to our bank account.
- The remaining amount is to be paid by credit card upon receiving the vehicle.

If the reservation is canceled:
- 4 weeks before rental period: 50% of the deposit is lost.
- 2 weeks before rental period: 100% of the deposit is lost.

4. Court of Justice
- Any lawsuit will be handled in the court of justice in Malaga, Spain.

5. Deposit by Credit Card
- A pre-authorized amount of €2,500.00 (or as stated in the rental contract) will be held on a MasterCard or Visa card only.
- By signing the contract, the renter permits Iron Skull Motorcycle, in case of accidents or damage to the vehicle, to withdraw the agreed deposit from the credit card.

6. Driving Rules
- The renter must respect and observe all traffic rules and regulations.
- It is not permitted to use the vehicle for racing on a race track, closed track, gravel, or unpaved roads.
- It is not permitted to drive off public roads, off-road, or on the beach.
- It is not permitted to drive without a valid EU or International driving license for the vehicle.
- NO DRIVING UNDER THE INFLUENCE OF ALCOHOL OR DRUGS IS ALLOWED.
- If Iron Skull Motorcycle or any staff suspect that the renter is under the influence at pickup, they can refuse to hand over the vehicle or ask the renter to take an alcohol or drug test.
- By signing the contract, you state that you are a skilled and experienced driver. If the staff finds out that you have withheld information about your driving experience, they can refuse to give you the motorcycle and your deposit will be lost.

IN CASE OF AN ACCIDENT UNDER THE INFLUENCE OF ALCOHOL, DRUGS OR PRESCRIPTION MEDICINE, OR DUE TO LACK OF OBSERVANCE OF TRAFFIC RULES, STOP SIGNS, WRONG PARKING, SPEED LIMITS, SPEEDING OR NOT DRIVING ACCORDING TO ROAD CONDITIONS, THE RENTER WILL PAY ALL EXPENSES TO HAVE THE VEHICLE REPAIRED.

7. Fines and Taxes
- We keep the credit card details for at least 6 weeks.
- By signing the contract, the renter permits Iron Skull Motorcycle to charge any fines the vehicle may receive during the rental period to the credit card used for the rental.

8. Fuel
- The vehicle must be returned with the same amount (or more) of fuel as at pickup.
- If not, a fee of €50.00 will be charged.

9. Garage / Parking
- When parked, scooters and motorcycles must be locked with the enclosed keys and lock.
- Accessories such as helmets and GPS devices must not be left on or at the vehicle when it is parked.

10. Insurance
- Only the renter is allowed to drive the rented vehicle, unless otherwise granted in writing.
- If this is not respected, the insurance coverage in case of loss of or damage to the vehicle will be lost.
- This includes lack of observance of traffic rules, stop signs, wrong parking, speed limits, and DUI.

11. Kilometers
- Unlimited kilometers within Spain.
- Driving in other countries is not permitted unless otherwise stated in the contract.
- If driving outside Spain is permitted in writing, the limit is 375 km per day. Extra kilometers are charged at €0.25/km.

12. Period of Validity
- Rental contracts for 1 day start at 10:00 and the vehicle must be returned the same day at 18:00.
- If the rental period is more than 1 day, it starts at 10:00 and the vehicle must be returned at 18:00 on the last day of the rental period.
- If the return time is delayed, the renter will be charged an additional fee of €50.00 per starting hour after 18:00.

13. Reservation
- The reservation comes into force when the deposit is paid and visible in the Iron Skull Motorcycle bank account.

14. Returning the Vehicle
- Unless otherwise agreed, the vehicle must be returned to Iron Skull Motorcycle, Avd. Carlota Alessandri 146, 29620 Torremolinos, Malaga.

15. Taxes
- All taxes are included.

IMPORTANT:
IN CASE OF AN ACCIDENT UNDER THE INFLUENCE OF ALCOHOL, DRUGS OR PRESCRIPTION MEDICINE, OR DUE TO LACK OF OBSERVANCE OF TRAFFIC RULES, STOP SIGNS, WRONG PARKING, SPEED LIMITS, SPEEDING OR NOT DRIVING ACCORDING TO ROAD CONDITIONS, THE RENTER WILL PAY ALL EXPENSES TO HAVE THE VEHICLE REPAIRED.
